    Marital Issues image

We have assisted countless clients already, both based locally and nationally, to resolve situations that they thought were irresolvable. We can help you with contractual disputes in, for example, the following types of situation:

    • Interpretation of partnership agreements / shareholders agreements.
    • Rejection of insurance claims i.e. damage to property, subsidence etc.
    • Interpretation of terms of a professional’s instruction i.e. third party agents, valuers etc.
    • Agency responsibilities.
    • Sale of goods and supply of services.

The above applies whether or not the agreement is set out formally in writing.

Has advice that you have received from a professional left you, or your business, with a problem that is costly to rectify?
    Perhaps you have:

    • Bought a property based on a surveyor’s report and subsequently found subsidence or a structural defect?
    • Perhaps a painting, that you were told by a valuer was worth a lot of money, turned out to be a less valuable copy?
    • Maybe you instructed a professional to assist you in buying a property but you have found it is subject to a restrictive covenant, right of way or ransom strip or there is a mistake in your lease?

We are able to assist you to recover your losses from any professional who has provided negligent advice.

Are you, or your business, involved in a building, development or landscaping dispute?

    • Are you dissatisfied with the quality of the service provided?
    • Is there a disagreement about whether or not remedial works are required?
    • Is a customer refusing to meet their obligation to pay?
    • Are you in dispute about how work has been charged for?
    • Are there issues surrounding whether or not the work has been completed on time?

You don’t have to be going through a divorce to find yourself embroiled in a dispute with family members.  You may share property with them, whether or not it’s a business, a house or land.  This type of situation often involves unwritten agreements between family members about monies paid into a home or business venture.

    • Inheritance
    • Loans or gifts between family members

Trust and probate disputes can be complicated to resolve and often have a strong emotional element.  When a loved one dies, the difficulties of dealing with the financial repercussions are often overwhelming.

Our expertise covers all aspects of probate disputes including:-

    •   Inheritance (provision for Family and Dependants) Act 1975 claims
    •   Undue influence or coercion
    •   Removal and substitution of personal representatives
    •   Personal liability of Trustees
    •   Claims involving lack of testamentary capacity
    •   Trust and charity disputes

These matters are only examples of the range of services we provide and we would be only too pleased to discuss your requirements with you.  Whatever your circumstances our trusted, experienced and resourceful team will provide you with practical, realistic and often creative solutions to your situation.  We offer a free, half hour, no obligation consultation to discuss your circumstances.  Our focus is on building a lasting relationship with our clients and we believe that getting it right matters.
